DMCA & Copyright Policy

1. Online Service Provider Safe Harbor

Malfoy Manga operates as an online software platform, comic reader viewer, and interactive community host. We do not engage in the unauthorized reproduction of copyrighted works for commercial sale. Upon receiving a proper notification of claimed infringement pursuant to 17 U.S.C. § 512(c), we act expeditiously to remove or disable access to the infringing material.

3. Statutory Requirements for a Valid DMCA Notice

Under 17 U.S.C. § 512(c)(3), for a notice to be legally effective, it must include all of the following elements:

1. Authorized Signature: A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
2. Identification of Work: Identification of the copyrighted work claimed to have been infringed, or if multiple works at a single site are covered by a single notification, a representative list of such works.
3. Exact URL / Location: Identification of the material that is claimed to be infringing and information reasonably sufficient to permit us to locate the material (please provide exact page or chapter URLs).
4. Contact Information: Information reasonably sufficient to permit us to contact you, such as your full legal name, physical address, telephone number, and email address.
5. Good Faith Statement: A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
6. Perjury Statement: A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

4. Counter-Notification Procedure (§ 512(g))

If you believe that your content was removed or disabled as a result of mistake or misidentification, you may submit a written Counter-Notification to our Designated Agent containing:

• Your physical or electronic signature.
• Identification of the material that has been removed or disabled and the location where it previously appeared.
• A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled by mistake or misidentification.
• Your name, address, phone number, and a statement consenting to the jurisdiction of the federal district court.

5. Repeat Infringer Policy

In accordance with the DMCA and other applicable intellectual property laws, Malfoy Manga has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, accounts of users who are deemed to be repeat infringers.
